Due Process, another fallacy. They get more than Due process. A lot of people think a deportable alien gets one shot at staying here. The truth is they usually get three. Congress set up visas and refugee programs that people can use before they ever come here. Once they’re in the country, they can apply with USCIS for asylum, a green card or a work permit. Then if ICE puts them in removal proceedings, an immigration judge can still give them relief even after finding them deportable. People like (thousands more) Abrego Garcia skipped the first one, blew past the one-year deadline for asylum on the second, and still got his day in front of a judge on the third. That’s a lot of process for someone who came in illegally. The real trouble is that the system lets cases drag on for years, and that’s where the fraud, waste and abuse come from. Congress could fix a lot of this right now. Give us more immigration judges so the backlog gets worked down. Put real consequences on people who file fake or frivolous asylum claims. Cap the continuances so a case can’t be stretched out forever. Stop using parole for things it was never meant for. Pay for enough detention space and removal flights so a final order actually means something. And make E-Verify mandatory so the jobs aren’t there to pull people in.
