ANDREW BRANCA: The Constitution vests lawmaking in Congress and judgment in courts—not in unelected bureaucrats rewriting rules to fit the politics of the moment. When judges defer instead of decide, agencies rule by memo and accountability vanishes. That’s not separation of powers—it’s government by shrug.
