So in this conversation with Dr. Shokar, did he ever tell you that if you wouldn't give him a pre-authorization for a ventilator that that would mean he was going to label Grace, "Do Not Intubate"?
No.
And there is a difference to you, is there not, between a pre-authorization versus actual intubation?
Definitely.
Did Dr. Shokar ever tell you that once he then labeled her "Do Not Intubate," that also meant to him he would then place a "Do Not Resuscitate" order in her chart?
Over-ruled.
That was never stated. In fact, when I was first on the stand here last week I explained very simply if that question would have been posed that way or that statement that way, just so you know if you don't want to give us a pre-authorization for a ventilator, that means DNI to us. And once we label somebody DNI, that means a DNR order will go in her chart. Well, all kinds of red flags would have gone up at that point.
And in terms of the red flags that would have gone up, you also heard some testimony during this trial, somebody questioning, "Why didn't you call Jessica and let her know that Grace was labeled "Do Not Resuscitate," DNR, do you remember that testimony?
I do.

Once admitted, Grace’s condition was mismanaged. Despite initially stabilizing with oxygen, hospital staff escalated her treatment to high-flow oxygen devices like Vapotherm and BiPAP within 24 hours, often without clear communication to Scott, who was present as her advocate. On October 10, Scott was forcibly removed from the hospital by an armed guard, accused of having COVID symptoms and interfering with care. During the 47 hours Grace was without an advocate, staff administered Precedex, a sedative, increasing its dosage six times. On October 13, while Grace’s sister Jessica was briefly absent, the hospital restrained Grace, leading to her defecating in bed.
